Terms and Conditions

Acceptance of risk

 

I acknowledge that I am participating in an off-road motorcycle activity. I understand that this activity may involve riding over variable terrain, possibly including loose surfaces, steep inclines, water crossings, and remote locations. I understand and accept that motorcycle riding carries inherent risks that may result in injury, illness, property damage, or death.

 

These risks include but are not limited to:

• Rider error or loss of control

• Mechanical failure of my motorcycle

• Collisions with obstacles, other vehicles, or terrain hazards

• Weather-related dangers

• Delays in access to emergency medical care

 

I confirm I am physically fit and competent to undertake this activity. I will be participating voluntarily, of my own free will, and I have not been coerced, pressured, or misled into taking part. I am legally an adult and hold a valid full UK motorcycle licence. I accept full responsibility for the control and condition of my own motorcycle, riding decisions, and personal safety. I understand that I am responsible for operating within my skill level and for maintaining a safe speed and distance at all times.

 

By continuing and attending the tour, I accept the terms and conditions laid out above and in this document.

Rider Eligibility Requirements

To participate, you must:

  • Be aged 18 or over.

  • Hold a full and valid licence appropriate for the motorcycle ridden.

  • Supply your own motorcycle.

  • Be physically and medically fit to ride.

  • Disclose honestly your level of riding experience.

 

Safety and Equipment Requirements

You must wear:

  • A full-face helmet meeting EC2205, EC2206 or equivalent standards (open-face helmets are not permitted) with visor, goggles or safety glasses.

  • Protective jacket and trousers with armour.

  • Back protector.

  • Boots covering ankle and shin.

  • Gloves.

 

Motorcycle Requirements

Motorcycles must:

  • Be road legal.

  • Be taxed and insured.

  • Hold a valid MOT (where required).

  • Be mechanically sound.

  • Be suitable for mixed terrain and trail riding.

  • Not be excessively noisy.

 

Motocross bikes, trials bikes and vehicles with more than two wheels are not permitted, even if road registered.

ATA may refuse participation where a rider is deemed unfit, unsafe or unsuitable for the planned route, if equipment is considered inadequate, or if a motorcycle is considered unsafe or unsuitable.

 

Code of Conduct

All riders must:

  • Follow guides’ instructions at all times.

  • Maintain safe distances and a controlled pace.

  • Ride within their limits.

  • Remain on the designated route.

  • Not perform wheelies, stoppies or aggressive riding.

  • Not overtake the lead guide unless instructed.

  • Respect the countryside, environment, residents and other users.

  • Not ride under the influence of alcohol or drugs.

  • You will inform guides immediately if unwell or unable to continue.

Failure to comply may result in removal from the tour without refund.

 

Accidents and Injury

In the event of an accident:

  • The safety of all riders is the immediate priority.

  • Guides will provide first aid within the scope of their training.

  • Emergency services will be contacted where appropriate.

If hospital transport is required, we will assist where reasonably possible with securing the motorcycle.

Recovery costs, storage fees and associated expenses remain the responsibility of the rider.

ATA does not provide personal accident insurance. Riders are strongly advised to obtain their own insurance.

Breakdown and Recovery

We will endeavour to enable riders to make minor repairs where safe to do so.

If recovery is required, the rider is responsible for arranging and paying for recovery and onward travel.

Riders are strongly advised to obtain their own breakdown and recovery insurance. ATA is not responsible for consequential losses, accommodation costs or transport expenses arising from breakdown.

 

Bookings and Payment

  • Tours are booked on a first-come, first-served basis.

  • Bookings are confirmed only when full payment is received.

  • Payments are made by bank transfer.

 

Cancellation Policy

 

Cancellation by ATA

ATA may cancel or amend a tour due to:

  • Severe weather

  • Safety concerns

  • Guide illness

  • Route closures

  • Events beyond our reasonable control

 

An alternative date or full refund of payments made will be offered.

ATA is not responsible for incidental expenses such as travel or accommodation.

 

Cancellation by the Customer

  • Deposits are non-refundable.

  • More than 7 days’ notice: ATA may, at its discretion, transfer payment to another date within 2 months.

  • Less than 7 days’ notice: payments are non-refundable.

  • No refund is due if a rider withdraws during a tour.

 

Limitation of Liability

 

Liability – Except where negligence is proven, ATA is not liable for loss, damage, or injury to you, your bike, or your property. This includes incidents arising from mechanical failure, poor maintenance, or rider error.

ATA shall not be liable for cancellation, delay or modification caused by events beyond our reasonable control, including severe weather, government restrictions, land access changes, illness, mechanical failure or other unforeseen circumstances.

 

Data Protection

ATA collects personal information including contact details, emergency contacts and relevant medical information for safety purposes.

This data is:

  • Used solely for administering tours and ensuring rider safety.

  • Stored securely.

  • Retained only as long as reasonably necessary.

  • Not shared with third parties except emergency services where required.

All data is processed in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018.
